Last Updated: [September 12, 2025]
Overview and Acceptance
This website is operated by Next Door Cannabis for nextdoorkc.com (“Site”), and these Terms of Service (“Terms”) govern access to and use of the Site, tools, and services, including browsing, ordering, pickups, deliveries, promotions, and loyalty programs (collectively, the “Service”).
By accessing the Site or using the Service, agreement to these Terms and all referenced policies is required; if there is disagreement, do not use the Site or Service.
New features or tools added to the Service are also subject to these Terms, which may be updated by posting changes on this page, and continued use after changes constitutes acceptance.
Eligibility; Age and ID Verification
Use of the Service is limited to adults of legal age, which for Missouri adult‑use is 21 or older, and access or purchase requires truthful ID verification as permitted or required by law.
Accounts and orders may be denied, suspended, or terminated if eligibility or identity cannot be verified or if suspicious or unlawful activity is detected.
Compliance and Local Restrictions
All use of the Service and purchases must comply with applicable federal, state, and local laws and regulations, including Missouri cannabis rules and municipal limitations.
Certain products or services may not be available in all jurisdictions, and availability may change due to regulatory requirements or operational decisions.
Account, Accuracy, and Security
Accurate, complete, and current information must be provided when creating an account or placing an order, and account details must be promptly updated to keep information current.
Responsibility for maintaining account security and for all activities under the account rests with the account holder.
Store Terms; Prohibited Conduct
The Service may not be used for any unlawful purpose, to solicit unlawful acts, to violate IP rights, to transmit malicious code, to spam or scrape, or to interfere with security or integrity of the Service.
Violations of these Terms may result in immediate termination of access, cancellation of orders, and potential reporting to authorities where required.
Information Accuracy and Availability
Content on the Site is provided for general information and may not be accurate, complete, or current, and reliance is at the user’s own risk.
The Site content may be modified at any time without obligation to update, and monitoring of changes is the user’s responsibility.
Products, Pricing, and Taxes
Product descriptions, pricing, and availability are subject to change without notice, quantities may be limited, and offers may be void where prohibited.
Applicable taxes and fees, including Missouri state cannabis taxes and any local taxes where applicable, will be applied to orders as required by law.
Orders; Acceptance; Limits
Orders are offers to purchase and may be accepted or rejected at discretion, including restrictions on quantities per person, household, or order, and on suspected reseller orders.
If an order is changed or canceled, reasonable efforts may be made to notify using contact details provided at checkout.
Payment; Processing
Payment must be authorized for the full amount at the time of order, and payments are processed by third‑party processors under their terms and security practices.
Full payment card numbers are not stored by the Site, and transmission of card data is encrypted by payment providers.
ID Checks; Pickup and Delivery
A valid government‑issued photo ID confirming legal age must be presented for pickup or delivery; refusal or inability to present valid ID may result in cancellation.
Delivery is available only where permitted by Missouri rules and local regulations, typically to private residential addresses and not to federal property or public spaces.
Delivery may be fulfilled by the store or an authorized third‑party licensee in compliance with Missouri DHSS rules and purchase limits.
No Mailing or Interstate Shipping
Cannabis and THCa products are not shipped via USPS or other carriers, and mailing marijuana is prohibited under federal law.
Orders cannot be fulfilled to out‑of‑state addresses or across state lines, and any attempt to redirect shipments is prohibited.
Returns, Exchanges, and Title
Except where required by law, sales of cannabis and THCa‑containing products are final and not eligible for return, and non‑cannabis merchandise returns follow the posted Return Policy.
Title and risk of loss pass upon lawful pickup or delivery handoff consistent with applicable law and verification requirements.
Third‑Party Tools and Links
Access may be provided to third‑party tools or services “as is” and “as available” without warranties or control, and use is at the user’s discretion under the third party’s terms.
Third‑party links may lead to sites not affiliated with the company, and no responsibility is assumed for their content, products, or services.
User Content; Feedback
Comments, reviews, ideas, or submissions may be used, edited, copied, published, translated, or distributed without obligation, compensation, or response, subject to applicable law.
User submissions must not violate rights of others, contain unlawful or harmful content, or include malicious code, and users are responsible for the accuracy of their submissions.
Health and FDA Disclaimers
Products and content are not intended to diagnose, treat, cure, or prevent any disease, and no medical advice is provided by the Site.
FDA has not generally approved cannabis products for medical use outside limited prescription drug contexts, and consumers should consider risks and consult healthcare providers as appropriate.
SMS/MMS Marketing (TCPA)
By opting into SMS/MMS marketing, the consumer provides prior express written consent to receive marketing texts at the provided number, including via autodialer, and consent is not a condition of purchase.
Messages may be sent only during permitted hours and must include clear identification and opt‑out instructions (e.g., REPLY STOP), and standard message and data rates may apply.
Consumers can revoke consent at any time by using provided opt‑out mechanisms, and consent practices will align with applicable TCPA rules.
Intellectual Property
All Site content, trademarks, logos, and other IP are owned by or licensed to Next Door Cannabis and protected by applicable IP laws, and use is limited to the permissions in these Terms.
Reproduction, duplication, copying, selling, reselling, or exploiting any portion of the Service without express written permission is prohibited.
Prohibited Uses
The Site and Service may not be used to violate laws, infringe IP rights, harass or discriminate, submit false information, upload malware, collect personal data unlawfully, spam, phish, scrape, or bypass security features.
Violation of prohibited uses may result in termination of access and potential legal action.
Disclaimer of Warranties
The Service, Site, and all products and content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness, durability, title, and non‑infringement.
No warranty is made that the Service will be uninterrupted, timely, secure, or error‑free, or that defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law, Next Door Cannabis and its affiliates, officers, employees, agents, suppliers, and licensors shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, savings, data, or goodwill, arising from use of the Service or products.
Where limits on exclusion of incidental or consequential damages are not permitted, liability shall be limited to the maximum extent allowed by applicable law.
Indemnification
Users agree to indemnify, defend, and hold harmless Next Door Cannabis and its affiliates, officers, directors, employees, agents, and partners from claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from use of the Service, violation of these Terms, or infringement of any rights.
Arbitration; Class Action Waiver
Except for claims brought in small claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
No class arbitrations or class actions are permitted, and the parties waive any right to participate in a class or representative proceeding to the fullest extent permitted by applicable law.
If the arbitration clause is found unenforceable as to a particular claim, that claim may be litigated in court, but the remainder will still be arbitrated to the extent allowed.
Governing Law; Venue
These Terms are governed by the laws of the State of Missouri and applicable federal law, without regard to conflict of laws principles.
Subject to arbitration, exclusive venue for any permitted court action lies in competent courts located in Missouri.
Severability; No Waiver
If any provision of these Terms is held unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any right or provision shall not constitute a waiver of such right or provision.
Changes to the Service and Terms
The Service may be modified or discontinued in whole or part at any time without notice, and no liability is assumed for such modifications or discontinuance.
These Terms may be updated by posting on this page, and continued use after posting constitutes acceptance of the changes.
